Terms and conditions

These terms govern the purchase of services from ("Ether Latino Social", "we"), a limited liability company organized in the State of Texas, United States. By paying for any service, you accept these terms.
1. Services
We provide social media management, digital advertising management, website development, graphic design, video and artificial intelligence assistants for WhatsApp and other channels, as described on our website and in the catalog in effect at the time of purchase.
2. Purchase and communication
Purchases, customer service and support take place over WhatsApp, email and the onboarding form. We do not offer phone support. Service begins once we receive payment and the completed onboarding form, with the necessary information and access.
3. Prices and payment
- Prices are in U.S. dollars and are charged by card through Stripe. We do not store card data.
- Monthly plans are billed in advance every month, automatically, on the purchase date.
- Contract plans (3, 6, 9 or 12 months): you commit to pay for the chosen term. At the end of the term, the plan continues month to month at the same price until you cancel.
- Month-to-month option: costs 20% more than the contract price and can be cancelled at any time.
- Yearly payment: charged once in advance, equal to 10 months.
- We may update prices with 30 days' notice; changes apply at the next renewal, never to a term already purchased.
4. Ad spend
Advertising spend (what is paid to Meta, TikTok, Google or other platforms) is not included in any plan. The client pays the platform directly with their own payment method. Platforms may approve, reject or limit ads under their own policies.
5. Results
We commit to delivering the purchased services with professional quality and reporting results every month. We do not guarantee a specific number of customers, sales, messages or followers, because these depend on factors beyond our control, such as location, offer, the client's prices, competition and ad spend.
6. Client responsibilities
- Provide truthful information, access and materials on time. Delays in providing information push back delivery dates.
- Ensure they hold the rights to the logos, photos, text and other materials they provide.
- Comply with the laws and licenses that apply to their business and to what they advertise, including industry rules.
- Review and approve content within the stated time frames.
7. Artificial intelligence assistant
The AI assistant identifies itself as a virtual assistant and responds using the information the client provides. The client is responsible for keeping that information (prices, hours, services, policies) accurate and current. The assistant always offers the option to hand the conversation to a person at the business. Its use is subject to the policies of WhatsApp, Meta and other platforms.
8. Intellectual property
Once paid in full, the client owns the final designs, logos, websites and content created for them. We retain the right to use templates, processes, tools and general know-how, and to display the work as portfolio samples unless the client requests otherwise in writing.
9. Hosting and domains
Websites include hosting for the first year. Renewal costs $147 USD per year. If the client does not renew, they may request their files to host wherever they prefer. Domains are registered in the client's name.
10. Suspension
If a payment is declined and not resolved within 7 days, we may pause the service until the balance is paid. Cancellations and refunds are governed by our cancellation and refund policy.
11. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to the services is limited to the amount paid by the client in the 3 months before the event giving rise to the claim. We are not liable for indirect losses, lost profits, or decisions, failures or policy changes of third-party platforms.
12. Governing law
These terms are governed by the laws of the State of Texas, United States. Any dispute will be resolved before the competent courts of Texas.
